They continue to mislead on Martin v. Boise. It does NOT require the City or County to allow the homeless to camp wherever they want whenever they want, nor does it require the City or County to provide services.
This article also overlooks the County’s obligation to assess the adverse impacts of the homeless on the environment as required by the California Environmental Quality Act. It also overlooks a reasonable alternate to the Binford Road location — the vast parking lot at the Civic Center. It would be far easier and less costly to mitigate the adverse impacts of the homeless on the environment. It would also make providing services to the homeless far more cost effective, thereby allowing a greater portion of the grant money to be applied to the homeless instead of another gaggle of county bureaucrats. And such a move could be completed within 3 weeks, well before the rainy season begins that will pump more of the pollution from the homeless into the Rush Creek Preserve.
