Subject: Binford Road — Time for action!

Dear Supervisor Lucan,

In light of this recent ruling, it’s time to take action on the mess along Binford Road:

No more excuses. You must act to enforce county laws instead of throwing your hands in the air.

    Francis,

Thanks for reaching out and sharing your feedback with regards to Binford Road. I would be very interested to hear any additional thoughts or suggestions you have in addressing some of the issues along Binford.

I have spent the past several months meeting with stakeholders, residents, adjacent businesses, airport users and county staff regarding Binford Road. We have recently made some improvements along Binford to close off some of the shoulders to enhance safety and a handful of abandoned vehicles were recently removed. We also have a fulltime employee that will be starting soon who will be focused on Binford Road and we have an grant request in with the state specific to Binford Road. We still have a lot of work to do in order to improve the situation.

I would be happy to chat more over the phone at your convenience. If you would like to chat, let me know a good time/number when I can reach you?

    Eric,

Thank you for reaching out. I’m tied up for the remainder of this week and next. I will be available again on Monday, April 10th.

For now, I would like to see the County approach the mess on Binford Road as though it were development subject to CEQA laws. What is going on is in effect a County “project” subject to CEQA. As you know, those laws require an evaluation of the adverse impact on resources, including impacts to the community as well as the wetlands and other protected resources.

The proper application of those laws would require the County to find a less harmful location for the people living there now. Doing so would also help the County properly apply the Ninth Circuit’s 2019 ruling in Martin v. City of Boise as did Judge Scott Blaney, the Maricopa County judge in the Phoenix case.

    Regards, Frank
